A. EXTENT OF LIMITED WARRANTY
  1. Mobiltab warrants hardware products against defects in materials and workmanship for a period of one year from date of purchase ("Warranty Period"). The customer is responsible for keeping all original proof of purchase documents during this time. Mobiltab will only accept purchase receipts from authorized retailers as proof of purchase. Receipts coming from credit card processing companies, including but not limited to PayPal, Authorizenet.com, Visa, Mastercard, Amex and Discovery, will not be accepted as proof of purchase.
  2. Concerning software products, Mobiltab Limited Warranty applies only to a failure to execute programming instructions. Mobiltab does not guarantee the operation of any product will be uninterrupted or error free.
  3. Mobiltab Limited Warranty covers only those defects which arise as a result of normal use of the product, and does not apply to:
    1. Improper or inadequate maintenance or modification;
    2. Software, interfacing, media, parts and supplies not provided or supported by Mobiltab; or
    3. Operation outside the product's specifications.
  4. If Mobiltab receives, during the applicable Warranty Period, notice of a defect in any hardware product, which is covered by Mobiltab warranty, Mobiltab will either repair the product using new or refurbished replacement parts or replace the defective product with new or like-new product of the same model or similar product with the same functionality as the original unit. If Mobiltab is unable to repair or replace the defective product, the customer will either be offered a comparable model* (if available) or will be refunded the purchase price of the defective product. When a product is exchanged, any replacement item becomes the property of the customer and the replaced item becomes Mobiltab property. (* whose functionality is at least equal to that of the product being replaced.)
  5. Mobiltab shall have no obligation to replace or refund a defective product until the customer returns the defective product to Mobiltab.
  6. Mobiltab is not responsible (i) for any data stored on returned products. Customers should backup his/her data prior to shipping the unit back to Mobiltab. Hard drives and devices which include a hard disk or other memory storage system will be reformatted during the repair process (even if the repair is not related to the hard drive itself) and will not include the customer's data when it is returned. (ii) for protecting the confidentiality of any data on a product sent in for repair.
  7. Mobiltab limited warranty is only valid in the country of purchase.
  8. The Mobiltab limited warranty is non-transferable. Mobiltab will not validate purchases made via trade, barter or auctions. This pertains to trade, barter or auction between individuals or between resellers and individuals on sites including but not limited to E-Bay and Ubid where trade, barter or auction transactions are facilitated.
  9. Mobiltab does not warrant against damages incurred to the LCD screen touch panel Digitizer or Frame and shell of the device. Devices returned with broken LCD screens or other damages will be evaluated by a Mobiltab technician who will determine if such damage falls within the scope of product neglect or misuse and hence whether or not it is guaranteed.
  10. The batteries in Mobiltab products have a finite number of charge cycles and thus over its life span, the autonomy will slowly decrease. Mobiltab does not guaranty a specific battery charge retention time scale as degradation of battery autonomy includes variables beyond the control of Mobiltab, such as, but not limited to, how often you deplete and charge it, the temperature the device is used and/or charged at, and the amount of time that the device is used or not used between charges.

  11. B. LIMITATIONS OF WARRANTY

    To the extent allowed by local law, neither Mobiltab nor its third party suppliers make any other warranty or condition of any kind, whether expressed or implied, with respect to the Mobiltab products, and specifically disclaim the implied warranties of conditions of merchantability, satisfactory quality, and fitness for a particular purpose. 

    C. LIMITATIONS OF LIABILITY

    To the extent allowed by local law, the remedies provided in this Warranty Statement are the customer's sole and exclusive remedies. To the extent allowed by local law, except for the obligations specifi cally set forth in this warranty statement, in no event shall Mobiltab or it's third party suppliers be liable for direct, indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory and whether advised of the possibility of such damages. 

    D. LOCAL LAW

    This Warranty Statement gives the customer specific legal rights. The customer may also have other rights that vary from state to state in the United States, from province to province in Canada. To the extent that this Warranty Statement is inconsistent with local law, this Warranty Statement shall be deemed modified to be consistent with such local law. Under such local law, certain disclaimers and limitations of this Warranty Statement may not apply to the customer. For example, some states in the United States as well as Canada may: preclude the disclaimers and limitations in this Warranty Statement from limiting the statutory rights of a consumer; restrict the ability of a manufacturer to enforce such disclaimers or limitations; or grant the customer additional warranty rights, specify the duration of implied warranties which the manufacturer cannot disclaim, or not allow limitations on the duration of implied warranties. 

    AUTHORIZED RETAILER RETURNS
    1. '
      1. ALL RETURNS REQUIRE A RETURN MERCHANDISE AUTHORIZATION (RMA). You can contact customersupport@mobiltabusa.com for RMA authorization or on our website by filling out the contact form If the product does not include all original materials or is not in original condition (no scratches or handling marks) or not properly working, Mobiltab may choose not to accept the claim as valid.
      2. Mobiltab will send you an RMA number and shipping instructions within 48 hours (weekends not included).

      3. THIRTY-DAY DEFECTIVE PRODUCT RETURN POLICY ( customer purchases made from Authorized Retailers)
        1. If the customer product ceases to function correctly within the first 30 days of ownership the Authorized Retailer shall exchange the product for the customer with a new working Mobiltab product, in this event Mobiltab will replace the product with a new one or issue a credit to the Authorized Retailer proof of purchase will be required from the Authorized retailer to show that the customer purchase is within 30 calendar days also all Mobiltab warranty policies will apply to these situations Authorized Retailer stores and store reps shall check all devices to make sure there is no customer negligence before authorizing an exchange please see Clause A." EXTENT OF LIMITED WARRANTY" for more information regarding Mobiltabs warranty policy (at your request).
        2. Mobiltab reserves the right to determine if a returned product is defective and falls within the warranty guidelines prior to any credit being issued or replacement with a new unit being made.
        3. ALL RETURNS REQUIRE A RETURN MERCHANDISE AUTHORIZATION (RMA). You can Email our support team at customersupport@mobiltabusa.com for RMA authorization You must submit a Request for RMA (Return Merchandise Authorization) form or contact our support team within 30 calendar days from the day the customer purchased the product.
        4. The product must be received by Mobiltab within 14 days from the date that the RMA number is issued. Any products received after this date will not be processed for return. After the 14 days have expired, you will need to contact Mobiltab for a new RMA number if you are still within the 30 calendar days following the reception of the product.

      4. RETURNS WITHIN THE ONE YEAR WARRANTY PERIOD PRODUCTS AFTER 30 DAYS OF PURCHASE( customer purchases made from Authorized Retailers)
        1. Mobiltab reserves the right to determine if the returned product has been rendered non-functional due to user misuse or improper handling.
        2. ALL RETURNS REQUIRE A RETURN MERCHANDISE AUTHORIZATION (RMA). Customer and or owner of product shall contact our support team (not authorized retailer) at customersupport@mobiltabusa.com for RMA authorization or use our contact request form page on our website to initiate the return and repair process. Mobiltab will work within a 'best effort' framework to send out your repaired product within 8-12 weeks from the reception of your product at its repair center, all Mobiltab warranty policies will apply for all claims, customers should check all devices to make sure there is no customer negligence before filing a warranty claim please see Clause A."         3. E. RETURNS
          1. 'No Questions Asked' 7 day return policy (Purchases made directly from Mobiltab)
            1. ALL RETURNS REQUIRE A RETURN MERCHANDISE AUTHORIZATION (RMA). You have the right to return a non-defective product to Mobiltab if you initiate an RMA process within seven days of the receipt of your product a 15% restocking fee will apply. You can contact customersupport@mobiltabusa.com for RMA authorization on our website (located under 'Product Returns'). If the product does not include all original materials or is not in original condition (no scratches or handling marks) or not properly working, Mobiltab may choose not to accept the product for a refund.
            2. Mobiltab will send you an RMA number and shipping instructions within 48 hours (weekends not included).
            3. This non-defective product must be received by Mobiltab within 14 days from the date that the RMA number was issued. Any products received after this date will not be processed for refund and will be returned to you at your cost. A 15% restocking fee is charged on all returned products purchases made with promo codes, friends and family discounts or Reseller sample purchases do not qualify for our 'No Questions Asked' 7 day return policy a 15% restocking fee is charged on all returned products .

          2. Thirty-day defective product return policy (purchases made directly from Mobiltab)
            1. If your product ceases to function correctly within the first 30 days of ownership, Mobiltab will replace your product with a new one or issue you a credit (at your request).
            2. Mobiltab reserves the right to determine if a returned product is defective and falls within the warranty guidelines prior to any credit being issued or replacement with a new unit being made.
            3. ALL RETURNS REQUIRE A RETURN MERCHANDISE AUTHORIZATION (RMA). You can Email our support team at customersupport@mobiltabusa.com for RMA authorization You must submit a Request for RMA (Return Merchandise Authorization) form or contact our support team within 30 calendar days from the day you received the product.

After the 14 days have expired, you will need to contact Mobiltab for a new RMA number if you are still within the 30 calendar days following the reception of the product.

          3. Returns within the one year Warranty Period
            1. Mobiltab reserves the right to determine if the returned product has been rendered non-functional due to user misuse or improper handling.

          4. Shipping Costs: The customer is responsible for shipping charges to Mobiltab. Mobiltab will cover the charges for return shipping. Mobiltab is not responsible for import fees, customs duties, or optional shipping insurance.

          5. Mobiltab is not responsible
            1. for any data stored on returned products. Customers should backup his/her data prior to shipping the unit back to Mobiltab. Hard drives and devices which include a hard disk or other memory storage system will be reformatted during the repair process (even if the repair is not related to the hard drive itself) and will not include the customer's data when it is returned.
            2. for protecting the confidentiality of any data on a product sent in for repair.

          6. All returns must be returned in the manufacturer's original packaging with the product. Make sure to include all cables, software, manuals and other items originally delivered in the package.

          7. All returns must have an RMA number clearly displayed on the outside of the returned package. If a return does not have an Mobiltab-issued RMA number, the package will be refused for delivery.

          8. All returns must be sent by USPS, Fedex or UPS service. If you receive goods in a damaged condition please inform the carrier (Post Office, UPS or FEDEX agent) immediately.

          9. All 'OUT OF WARRANTY' repairs may be subject to a nominal repair fee. Please contact Mobiltab for current charges.
